North Carolina law distinguishes between different types of homicide. First-degree murder requires premeditation and deliberation, or killing during the commission of certain felonies. Second-degree murder involves malice but lacks the premeditation element. Voluntary manslaughter applies when the killing occurs in the heat of passion following adequate provocation.
These distinctions matter enormously for sentencing. A first-degree murder conviction in a capital case can mean death or life without parole. Voluntary manslaughter, by contrast, may result in a substantially shorter sentence. Effective defense often involves challenging the government’s characterization of the offense and presenting evidence that supports a lesser charge.
The Role of Self-Defense
North Carolina recognizes the right to self-defense. Under the Castle Doctrine, you have no duty to retreat within your own home when facing an intruder. Even outside the home, deadly force may be justified if you reasonably believe it necessary to prevent imminent death or great bodily harm.
In 2017, I represented a woman who shot an intruder in her home. By working closely with investigators and presenting surveillance video that proved self-defense, I convinced the District Attorney to decline charges entirely. My client faced no prosecution because we built an overwhelming case for justification before charges were ever filed.
Capital Defense Experience
I serve on the Capital Defender First Chair Roster and the NC Habeas Capital Roster for death penalty cases. These appointments reflect my experience with the most serious criminal prosecutions. In 2019, my co-counsel and I successfully prevented a death sentence in a triple homicide case in Wake County by presenting compelling psychiatric testimony about the defendant’s mental illness.

In the Club Bodi murder case in 2019, my cross-examination exposed lies told by the lead investigator. The result was a hung jury with ten jurors voting to acquit. While that outcome fell short of complete acquittal, it demonstrated how vigorous defense can prevent wrongful conviction even when the prosecution presents apparently strong evidence.
