
Q: I’m being investigated by SafeSport. Can this turn into a criminal case?
A: Yes. While SafeSport is not a law enforcement agency, it can and does refer cases to local, state, and federal law enforcement. A SafeSport investigation and a criminal investigation can run simultaneously, and what you say or do in one proceeding can affect the other.
How Referrals Work
SafeSport is required by law to report allegations of child abuse to appropriate authorities. For other types of misconduct, SafeSport may choose to refer matters to law enforcement based on the severity of the allegations. Law enforcement agencies can also independently open investigations based on the same underlying conduct.
The Danger of Dual Proceedings
This is where things get dangerous. Statements you make to SafeSport investigators can potentially be used against you in a criminal prosecution. Unlike a police interrogation, SafeSport does not give you Miranda warnings. If you cooperate fully with SafeSport without legal counsel, you may inadvertently provide evidence that helps build a criminal case.
Protecting Yourself
If there is any possibility that your SafeSport matter could have criminal implications — particularly allegations involving minors, sexual misconduct, or physical abuse — you need a defense attorney who understands both the SafeSport process and federal criminal defense. The strategy for handling one proceeding must account for the other.
